ARTICLE 1 – SIDES

MATTER 2 – SUBJECT AND PURPOSE AND SCOPE OF THE AGREEMENT

The subject and purpose of this Agreement is the electronic commerce website of Kos Living with www.kosliving.com extension ("Web site") is the regulation of the rights and obligations, declarations and commitments of the Parties within the scope of the membership transaction to be carried out through 

ARTICLE 3 – CREATING THE MEMBERSHIP

  • In order to create the membership, the name, surname, e-mail address, date of birth, mobile phone number requested on the membership page of the Website and the password to be created by the Member (“Membership Information”) is entered in full; by granting the requested approval and/or permissions thereafter,Sign up” button should be clicked. 
  • 3.1 of this Agreement. Errors and/or deficiencies regarding the Membership Information entered by the Member on the Website, and the opportunity to correct and complete these, are provided to the Member, by giving a warning, during the creation of the membership specified in the article. In this framework, if there is an error and/or deficiency regarding the aforementioned information, the Member has the opportunity to continue by correcting and completing them, in line with the warning messages provided to the Member. 
  • Kos Living undertakes that upon the completion of the membership process, it will be sending this Agreement to the e-mail address specified by the Member during membership. This Agreement, in addition, is located in the [ extension of the Website. The parties accept, declare and undertake that this Agreement will not be prepared separately with the Membership Information attached. 

ARTICLE 4 - UPDATING THE MEMBERSHIP INFORMATION 

  • Member, 3.1. of this Agreement. and 3.2. accepts, declares and undertakes that it will add the Membership Information correctly, completely and without errors, while creating a membership in accordance with its articles; In case of deficiencies and/or errors following the completion of the membership, the "My account” tab (“My Account Tab”) will be able to make the relevant changes or make the necessary corrections by communicating with Kos Living, verbally or in writing, through the communication channels specified in this Agreement. 
  • The Member will be able to update the Membership Information that he/she has declared within the scope of his/her membership at any time, via the My Account Tab or through the communication channels specified in this Agreement. The approval and/or permissions given by the Member during the creation of a membership and, if applicable, when shopping on the Internet Site, will also be valid for the updated Membership Information. 

ARTICLE 5 – TERMINATION OF MEMBERSHIP 

  • The Parties accept, declare and undertake that the Member may terminate his/her membership at any time, via the My Account Tab or through the communication channels specified in this Agreement, without giving any reason or facing any criminal liability, with immediate consequences. For the avoidance of doubt, at the time of termination of membership, if an order has already been placed on the relevant account, Kos Living will complete the relevant order, unless otherwise requested by the Member. 
  • Kos Living reserves the right to terminate and/or suspend the Member's membership if deemed necessary. 

ARTICLE 6 – RULES ON SECURITY AND PRIVACY, PROTECTION OF PERSONAL DATA, ELECTRONIC COMMUNICATIONS AND INTELLECTUAL AND INDUSTRIAL RIGHTS

  • The parties hereby declare that the rules and conditions applicable to Kos Living and the Member regarding the transaction security on the Website, the protection, confidentiality, processing, use of Membership Information and other information and commercial electronic communications; They accept, declare and undertake that it is possible for the Member to reach and consult Kos Living at any time, on related matters, through the means of communication specified in this Agreement. 
  • The Member states that the necessary measures for the security of Membership Information and membership transactions have been taken by Kos Living in its own system infrastructure, within the scope of technical possibilities, according to the nature of the information and transaction; However, since the said information is entered through the device used by the Member, the Member accepts, declares and undertakes that it is the responsibility of the Member to take the necessary measures, including those related to viruses and similar harmful applications, in order to protect them and prevent them from being accessed by unrelated persons. 
  • The Member, Kos Living's membership to the Member's Website and, in case of a question, the personal data obtained during his shopping, as detailed in the Customer Disclosure Text on the Website, existing and future within the group companies he is involved in. to share, save, process, and in accordance with legal terms for electronic and other commercial-social communications to be made with companies for product supply, all kinds of information, advertising-promotion, communication, promotion, sales, marketing, store card, credit card and membership applications. may store, update, share, transfer, transfer, use when deemed necessary; may also submit this data to the relevant authorities and courts upon request and/or legal requirement; In this context, it consents and permits the use, sharing, processing of existing and new personal data, in accordance with the legislation on the protection of personal data and electronic commerce legislation, and to make electronic communications and other communications, whether commercial or non-commercial, to the party; You can always stop communications by contacting Kos Living through the communication channels specified in this Agreement, using the right to refuse the use and processing of data and/or electronic communications sent to the Member; According to his clear notification on this matter, personal data transactions and/or electronic communications with the Member will be stopped within the legal maximum period; furthermore, upon request, information other than those required to be kept legally and/or possible will be deleted from the data recording system or anonymized in an anonymous manner; Objection to the emergence of a result against the Member by means of transactions related to the processing of personal data, the persons to whom it is transferred, correction in case of incomplete or inaccuracy, notification of the corrected information to the relevant third parties, deletion or destruction of data, analysis with automated systems, that you can always apply to Kos Living through the communication channels herein and get information from Kos Living, in matters such as the removal of damages in case of damage due to processing; It accepts, declares and undertakes that its applications and requests in these matters will be fulfilled within the legal maximum period or that its legal justification may be explained to the Member and may not be accepted. 
  • The Member, within the scope of Article 4 of this Agreement, takes action to approve and/or authorize electronic communication via the My Account Tab, following the Member's updating the Membership Information and changing the electronic communication preferences in terms of any communication channel or stopping them. accepts, declares and undertakes that it will continue to receive electronic communication through the relevant communication channel, without the need for further approval and/or permission and without taking into account the previous rejection notifications, based on the approval and/or permission given in this Agreement and otherwise. 
  • The Member is responsible for all kinds of information and content of the Website and their arrangement, revision and partial/full use; Except for those belonging to other third parties according to Kos Living's agreement; all intellectual and industrial rights and property rights belong to Kos Living; Kos Living reserves the right to make any changes it deems necessary regarding these matters; accepts, declares and undertakes that these changes will be valid from the moment they are announced on the Website or by other appropriate methods. 
  • The Member states that the privacy-security policies and terms of use of the relevant sites are valid on other sites accessed from the Website; Kos Living accepts, declares and undertakes that it will not be responsible for any conflicts and negative consequences that may arise for this reason. 

ARTICLE 7 - OTHER PROVISIONS 

  • The Member accepts, declares and undertakes that if the Member makes purchases on the Website, the relevant transactions will be subject to the provisions of the Preliminary Information Text, the Distance Sales Agreement and the Return and Cancellation Policy, which will also be brought to his attention. 
  • All kinds of informative documents on the Website, including the Privacy and Personal Data Protection Policy, Cookie Policy and Customer Clarification Text, are integral parts of this Agreement. 
  • If the parties notify Kos Living, verbally or in writing, about the Member's requests and complaints regarding membership, through the communication channels specified in this Agreement, Kos Living will be responsible for meeting the Member's justified requests and complaints and all kinds of applications. They accept, declare and undertake that they will be pleased. 

ARTICLE 8 - NOTIFICATIONS 

Any correspondence to be made between the Parties under this Agreement will be made via e-mail, except for the obligatory cases listed in the legislation. The Member agrees that in disputes that may arise from this Agreement, Kos Living's official books and commercial records, electronic information and computer records kept in its own database and servers will constitute binding, conclusive and exclusive evidence; accepts, declares and undertakes that this article is in the nature of an evidential contract pursuant to article 193 of the Code of Civil Procedure No. 6100. 

ARTICLE 9 – AUTHORIZED COURT AND RESOLUTION OF DISPUTES 

This Agreement will be subject to the laws of the Republic of Turkey and will be interpreted in accordance with such laws. Istanbul Çağlayan Courts and Enforcement Offices will be authorized to resolve any dispute arising from this Agreement. In so far, the Member always has the right to make his applications regarding the dispute regarding his purchases to the consumer court or the consumer arbitration committee. 

ARTICLE 10 – FORCE 

If this Agreement is approved electronically by the Member, it will become binding and will be deemed to have entered into force as of the date of approval.
